The first degree of the Supreme Federal Court (STF) begins an analysis of this Friday (09) request to suspend a criminal action against Federal MP Alexander Ramjim, who was approved in the House of Representatives on Wednesday (7).

The experiment will be performed in a virtual format, starting at 11 am. Until 11 am next Tuesday, the ministers will have their votes.

Ramaj, like former ministers, military individuals and former President Gere Bolsonaro (PL), is the defendant in STF because of his alleged involvement in a coup attempt.

By 315 votes to 143, the deputies have proven a draft law law submitted by Representative Alfredo Gasbar (Al -Ittihad), scheduled for the Constitution and Justice Committee (CCJ), which fully suspends the criminal procedure against the branch.

The proposal also opens the violation of the interpretation to cover the entire investigation, including other defendants in the case – even if this is indicated as “unconstitutional” by deputies.

Criminal work suspension

The mayor, Hugo Motta (Republicans-PB), on Thursday (8) sent a letter to the head of Stf, Luis Roberto Barroso, and asked to comment.

The application was submitted by PL based on Article 53 of the Constitution, which guarantees deputies and members of the Senate Civil and Criminal immunity for their opinions, words and voices.

The article also states that if there is a complaint of a crime committed after the diploma, the Supreme Court must transfer Congress, which, as an initiative of the political party, must be decided to support the process.

Despite the CCJ decision, STF must prevent the complete cancellation of the operation against the branch. The decision of the House of Representatives can only reach the charges of crimes that would have occurred after the diploma – as the constitution was established.

Ramagem is accused of five crimes, but only two would have occurred after his diploma as a deputy: qualified damage with violence or a serious threat against the assets of the union, causing great damage and the deterioration of the transferred assets.

Ramagim was the director of the Brazilian Intelligence Agency (ABIN) in the government of Jair Bolsonaro (PL). It is the only parliament that is the defendant in the supposed coup attempt after the 2022 elections.
