There are candidates who will not have judicial elections

In electoral judicial provinces 2 and 4 from the city of Mexico, there will be no jurisdiction when choosing a judge in family issues specialized in national and international adoption: in each case, there is only one candidate.

That is, they are applicants who do not have a discount, so they will win with one person who votes for them.

“If we vote for one candidate, this is not a democracy,” Fernando Daworak, who explained that one of the basic principles of democracy is the factional competition.

He pointed out that for months, there was a conversation that the judicial elections would weaken justice, “but if the goal is that there could be no democracy without efficiency.”

“When there is one candidate, voters do not have a real option, he is a person who will finally win (…) this makes the process just formal, and the democratic principle of electoral competition,” said professor and researcher at the College of Political Science at Unam Jacob Villagómez.

In response to a question about this, electoral chancellor, Sonia Perez, answered: “It seems to me that this is something that they will have to evaluate in the local Congress, with the aim of the upcoming judicial electoral process.”

“Because not only that perhaps in the selection process conducted by the committees, you did not find suitable people, it may be the case that the person is the only proposal for the three authorities (executive, legislative and judicial), which is a unique nomination.”

Villagómez added that these cases where there is no efficiency are the effects that the approval of judicial reform at the federal and local level has been transferred, because it was not expected to be done in cases where only one candidate is and how to ensure efficiency of all charges.

DWORAK stated that a solution to ensure competition is that in cases where unique candidates were competing against the judges who are currently occupying this space.

In this regard, Minister Perez stated that this possibility is not considered in the law.

During the process of verifying the authenticity of the profile by the selection committees, in cases where no one approved candidate was announced, the competition for that space was announced and it was determined that the current judge continued his position until the upcoming judicial elections.

This is the case of the six candidates for the positions of judges that were deserted in the overcoming process carried out by the Legislative Authority’s selection committee: These are four candidates for two positions from the family judge who specializes in national and international adoption and two to occupy the position of civil judge specialized in extinction of the field.
