A new list of the Ministry of Labor and Employment changes on Sunday and holidays in the trade sector. The main change requires the provision of the collective labor agreement (CCT) so that various commercial activities can work these days, except for free markets.
This measure will enter into force on July 1, after its successive postponement.
Legislation is not prohibited from working in trade these days, as it was organized under 25 years of law. The government decree changes a previous base, published in the administration of former President Gear Bolsonaro, which allowed work on Sunday and holidays through a simple agreement between presidents and employees, which the current administration considers illegal.
With the new decree, this agreement must be signed through collective agreements. It involves, on the one hand, the employer union, and on the other side, the workers. The standard also states that the presidents will be asked to respect municipal legislation on this subject, which was not necessary before.
Decree No. 3665 was published on November 13, 2023. It was stimulated with complaints from unions that claimed lack of respect for legislation that guarantees the right of commercial workers to negotiate working conditions on Sundays and holidays.
The declared goal was to enhance the spirit of collective bargaining.

The federal government attempted to obtain this measure in 2023, but it was postponed several times due to the dissatisfaction of employers resulting from the proposal. In addition to the commercial sector, which was considered a setback, there was a great pressure of parliamentarians associated with the sector.
The new rule requires that for anyone and the permissible holidays in the commercial sector, there must be a signature agreement through a collective agreement. They will defend the terms specified for each sector or category within the trade.
