The resumption of the owner of StJ judges accused of rape in DF

Judges of the Supreme Court of Justice (STJ), on Wednesday (23), the appeal of Gabriel Ferrera Meskita, the owner of Barbamb Bar, in Asa Norte, the administrative zone of the federal region. He is accused of rape and tries to reversed the conviction that the court recovered in August last year.

Gabriel was accused by 12 women of sexual assault, and in this process, one of the victims states that he met the human being agreed to preserve sexual intercourse, but at some point they was asked to stop this act, but the defendant ignored her and “forced anal sex” and raped her.

The accused was convicted in 2022 by the second criminal court of Brazilia for a period of six years in prison under an open system, but he appealed and the victim’s testimony was nullified. Gabriel was acquitted by the third committee of the DF (TJDFT) Court of Justice in May of the following year.

After the decision, the public prosecutor submitted the appeal to StJ, and in 2024, the court accepted the reflection of innocence, and the restoration of the defendant’s conviction.

Gabriel was sentenced to eight years in prison due to weak rape in July last year in another operation. In this case, Tjdft understood that he gave another victim and forced sexual intercourse. The decision determines that a penalty is made in a closed system, given that the crime is considered heinous.

In addition to rape, the man photographed the crime without approval, and presented the photos to a notary as a guide in this process. The woman became familiar with the video only when Gabriel’s defense presented the photos in an audience. Thus, another police report was recorded in January this year.

In the first complaint, she was reported that she had two meetings with Gabriel, as she was the first approved and what appears in the photos submitted to the court. At the second meeting, according to the case, he gave the victim and raped her.

Judge Evar Niris de Matos said: “The victim, in the state of sugar in which he was, was unable to agree to the sexual practice required by the defendant, much less to provide resistance to his behavior,” said Judge Evar Niris de Matos.
