The draft Law 4742/24, which was composed by Representative Danny being (UNIãO-RJ), proposes a detention of those who use the cell phone, video camera or other equipment that may be exposed to the voting vote, while in the voting cabin.

By justifying the proposal, the deputy stated that the goal is to make the punishment for voters more striking to violate the secret of voting.

“We propose the current project the goal of sclerosis on the voter, who failed to comply with the duty not to use the equipment that may violate the confidentiality of the vote.”

According to the suggestion, bringing any of this equipment to the cabin, even if it is turned off, can generate a sentence from 1 to 3 years of detention, and a fine ranging from 500 to 1000 dollars.

In the event of a violation of the confidentiality of voting or electoral polls, the expected penalty is from 2 to 5 years of detention. The same punishment applies to those who reveal the information obtained inside the cabin.

The voter still must stop the devices and deposit immediately in the eyes of the electoral polling stations. Those who refuse to vote will be prevented.

The deputy added: “We suggest that the size of the cell phone or similar equipment, in the voting booth, is punished for criminality.”

Currently, the Supreme Electoral Court (TSE) This practice is already prohibited, and it tends to adopt rules to reduce the lack of compliance with the voting secrecyAs shown by Law No. 9,504, known as the Electoral Law.

This new proposal aims to criminalize and punish the port for this procedure, and change the current legislation, including electoral law.

The draft law will now pass the Constitution, Justice and Citizenship Committee in the House of Representatives, and if approved, it will continue to vote in the plenary session.

To become a law, the proposal will need approval by the House of Representatives and the Senate.
