The Municipal Prosecutor (PGM) in Porto Alegre estimates that if he is convicted of the collective procedure submitted by the Public Prosecution (MP), the capital cost should reach $ 4.7 billion. According to PGM, the amount corresponds to approximately 40 % of the municipality’s annual budget.
The potential cost of public tanks has been calculated from the average values that the judiciary is arrested in such procedures and the extension of the flood stigma, which covers 160,000 people.
Last week, the court complied with the prosecutor and suspended the treatment of individual procedures with compensation claims 2024 flood. The deputy presented a collective measure asking the Municipality of Porto Alegre responsible for moral and material damage and compensation for the affected persons. In addition, it wants to pay 50 million dollars as a collective moral damage – the amount that should be estimated to the box and use it to enhance the increasing flexibility in the city.
As for the public prosecution service, the municipality committed the negligence that led to a failure of flood protection systems.
On the other hand, according to the municipal public prosecutor, JHONNY PRADO, to form administrative omission, is evidence of non -compliance with a legal duty to act. “If there is an omission in the case of flooding for the year 2024 – which does not seem to be the case, given that it is an unusual and inevitable situation that reached 95 % of the state municipality – the duty of the specified behavior was the union, which is responsible for protection against floods and climate suffering, according to the federal constitution.”
Rio Grande de Sol and Al -Ittihad are not the defendants at work. In the MP’s understanding, the full protection system is managed only by the municipality, without responsibility for other federal entities.
