Representative Arnaldo Jardim said on Monday (5) that he intends to bring him to the plenary session of the final report of the new legal framework for privileges and partnerships between the public and private sectors (PPPS). According to him, the idea is to vote on the article on Tuesday (6), with the highest presence of parliamentarians.
The deputy also said that he could still make adjustments to the final text.
“I have received some suggestions and I must make some amendments to opinion. We will work with some modifications, we will have the accredited opinion. We must be unanimous among leaders. (Mayor, Hugo), putting this project as a priority with government support.
When asked if there was an agreement to vote amid the possibility of disabilities by the opposition, he answered that there was a dialogue with party leaders in the House of Representatives. “The leaders have commented that this would be the seat and discuss it,” he said.
According to him, the expression was built collectively and is based on the search for consensus.

The report deals with the draft law 7.063/2017, which has already been approved by the Chamber. The text is a priority by the Speaker of the House of Representatives, Hugo Motta (Republican), and has government support.
Arnaldo Jardim highlighted the need to agree to the text to reduce legal uncertainty and the size of the court disputes that involve concessions in the country.
“Purchasing power and privileges are equivalent to it, but the volume of concessions in Brazil has no parallel. Nearly 30 % of the concessions have legal battles,” he said.
After years of discussion on the various infrastructure sectors, the new framework for PPPS seeks to update the rules and give more legal certainty of projects in the fields of energy, transport, sanitation and other public service concessions.
The auction rules proposal proposes, contractual balance, guarantees and final dates for the analysis of control bodies.
as CNNAmong the main points, the text determines a period of 120 days for the Federal Review Court (TCU) to analyze the concession projects submitted by organizational agencies or by a grant authority.
It also provides for automatic rates when determined by mathematical rates and formulas, without the need for a previous governmental or organizational agency, provided that the granting authority does not agree to values within 30 days after the contractual date.
The proposal also allows the intersection of projects from different sectors in the same contract, such as the port and railway, and brings lighter rules to transfer control over concepts in concessions.
Another innovation is the creation of “triple agreements” between granting power, concession and financiers, to ensure the continuity of projects even if there are problems with the operating company.
One of the most controversial points of opinion is to cancel an article on the Environmental Crime Law (Law 9.605/1998), which provides for imprisonment for public employees who are granted environmental licenses in disagreement with legislation.
Jardim defended the change. He said at the press conference: “No responsibility is canceled for an environmental agency. What he says is that the director or technician who signs and has an opposite procedure, and who will answer is the same body.
The deputy has already announced, in the text of the opinion, that the changes seek to “resolve doubts in the current legislation, to reduce the lawsuits that occurred, in addition to being necessary to enhance the concessions of public services in Brazil, protect the public interest and provide more prediction and legal certainty of all participants.”
